Tone Deaf Productions Disclaimer

1. Upon booking Tone Deaf Productions, the interested establishment must sign this disclaimer stating all liability, be it legal or otherwise, is the sole responsibility of the individual ( for the purposes of this document is hereby known as .Contracted Individual. ) whose signature is on this document. Tone Deaf Productions will not take part in any illegal activities, performances or underage alcoholic events.

2. Should Tone Deaf Productions incur any damaged equipment while performing at your event at said establishment by crowd involved activity, all liability for damaged equipment falls upon the establishment. If any equipment damage is sustained, an itemized list will be presented before our company leaves the event. All equipment is purchased and/or repaired through Musician.s Friend Inc.  No other business is used for repair and/or replacement. Any damaged equipment charges and shipping fees will be billed after a replacement has been found, that charge will be mailed for your prompt payment.

3. Tone Deaf Productions will provide, free of charge, no more than 10 flyers for your event if requested. These flyers may NOT contain any illegal information, profanity, or Pornographic material. A template can be requested in a Microsoft Word . format.

4. Tone Deaf Productions will provide a page of information about your event on our website with the name you choose. Said page may include pictures, directions, etc. . . pending the information contains no illegal, profane, or pornographic material. All Material is subject to approval. There may be a bandwidth fee.

5. Tone Deaf Productions makes it the liability of the contracted individual to provide a safe environment for our company to set up and perform in, without physical threat posed to the equipment, including and not limited to vehicles used for transporting such equipment, or the DJ/KJ performing the event for Tone Deaf Productions. Perceived threat is at the sole discretion of the performing DJ/KJ.

6. Notice of cancellation must be made at least 7 days in advance.

7. Customers may request setup by specified times, but may be no sooner than 1 hour before scheduled start time. These setup times may be adjusted, but with the agreement that full liability will be placed on the establishment where event will be held, for any or all equipment missing or damaged while Tone Deaf Productions is off location.

8. All ASCAP and BMI licenses are the sole responsibility of the contracted individual. Tone Deaf Productions assumes no liability with ASCAP or BMI. The contracted individual will assume all financial and legal liability in the event ASCAP or BMI decide charges must be applied.

9. It is the goal of Tone Deaf Productions to provide you with a professional system and the expertise to make your event a success. From time to time, friends and family of Tone Deaf Productions will attend public events. Rest assured they will be treated with the same regards as any paying customer. All name rotation lists for the event are established on a first come first serve basis. If a person should fail to appear in 2 rotation cycles, it is assumed the person has left or is no longer interesting in performing. The name will be erased from the list. If this person should wish to perform again, the name will be added to the bottom of the rotation. Tone Deaf Productions realizes that we are not hired to entertain. We will however put our names in the rotation to get it started. If the rotation count exceeds 18 names we will take ourselves out. Rude or obnoxious behavior WILL NOT BE TOLERATED. Tone Deaf Productions reserves the right to ban any performer at anytime.
